Zalchos Terms of Service

These terms apply to your use of the Zalchos customer app, Zalchos Driver app, vendor portal and zalchos.com (the "Service"), operated by 2800119 Alberta Inc, 1085 Mahogany Blvd SE, Calgary, Alberta T3M 3X4 ("Zalchos"). By using the Service you agree to them.

1. What Zalchos is

Zalchos is a marketplace that connects customers with independent stores ("Vendors") and independent delivery drivers ("Drivers"). Vendors are responsible for their products, pricing, licences and order preparation. Drivers are independent contractors, not employees of Zalchos.

2. Accounts

You must be at least 18 and provide accurate information. Keep your login private. You are responsible for activity on your account. You may delete your account at any time (see zalchos.com/delete-account).

3. Alcohol and age-restricted products

• You must be of legal drinking age in Alberta (18+) to order alcohol.
• Drivers will check valid government photo ID at delivery. We or the Driver may refuse delivery, without refund of fees where the refusal is reasonable, if no valid ID is shown, the recipient is under age, or the recipient appears intoxicated.
• Alcohol may only be delivered to the person who placed the order or an adult they name, and not to minors or intoxicated persons.
• Orders may be refused or cancelled in line with Alberta liquor laws (including AGLC requirements).

3A. Delivery area and hours

Delivery is available only in areas and hours shown in the app and may change.

4. Orders and payment

Prices are set by Vendors. Your total includes items, taxes, delivery and service fees, and any tip, shown before you pay. Card payments are processed by Stripe. An order is confirmed when the Vendor accepts it. A Vendor may decline an order, in which case you will not be charged or will be refunded.

5. Cancellations and refunds

You can cancel before the Vendor accepts the order for a full refund. After that, cancellation may not be possible. If an item is missing, incorrect or not delivered through no fault of yours, contact support@zalchos.com within 24 hours and we will work with the Vendor to correct or refund it. Refunds go to your original payment method.

6. Drivers

Drivers must be of legal age, have the right to work and drive in Canada, keep any required licence and insurance, obey traffic and liquor laws, and complete payout setup with Stripe. Pay is shown in the app. Drivers control their own schedule and may accept or decline requests.

7. Vendors

Vendors must hold all licences needed to sell what they list, keep listings accurate, and prepare orders promptly. Zalchos charges a commission and fees as agreed in the vendor agreement.

8. Acceptable use

Do not misuse the Service, give false information, interfere with deliveries, harass others, attempt to bypass age checks, or use the Service unlawfully. We may suspend or end accounts for breach of these terms.

9. Disclaimers and liability

The Service is provided "as is". Zalchos does not make, store or control the products sold by Vendors. To the extent the law allows, Zalchos is not liable for indirect or consequential losses, and our total liability for a claim is limited to the amount you paid for the affected order. Nothing limits liability that cannot be limited by law, including consumer rights you have under Alberta law.

11. Changes

We may update these terms. Continued use after a change means you accept it.

12. Governing law

These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Disputes go to the courts of Alberta.
